Terms of Service

These terms describe what you can expect from Fundamental and what we expect from you. They are written in plain English to keep things straightforward. We are still in private beta and recommend you have a lawyer review this document before relying on it for any regulated use case.

Who we are

Fundamental ("we," "us," or "the app") is a seasonal wellness companion based in the science of Ayurveda. By using the app or the website at fundamental.lifestyle, you agree to these terms. If you do not agree, please do not use the service.

Not medical advice

Fundamental provides general educational content about seasonal living, food, and self-care practices. It is not a medical service. Nothing in the app is a diagnosis, prescription, treatment plan, or substitute for professional medical care.

Always consult a qualified health professional before starting, changing, or stopping any health-related routine, especially if you are pregnant, nursing, taking medication, or managing a medical condition.
Never use the app to make decisions in an emergency. If you are experiencing a medical emergency, call your local emergency number.
Practitioners using the app are responsible for their own clinical judgement and for following the laws of the jurisdictions in which they practise.

Eligibility

You must be at least 13 years old to use Fundamental. If you are between 13 and 18, you may use the app only with the consent of a parent or legal guardian.

Your account

You may use Fundamental without an account. If you create an account, you are responsible for:

Providing accurate sign-up information
Keeping your password secure and not sharing it with others
All activity that happens through your account

If you suspect someone else has accessed your account, change your password immediately and write to support@fundamental.lifestyle.

Acceptable use

You agree not to:

Use the app to harm, harass, defraud, or impersonate any person
Try to break, probe, scrape, reverse-engineer, or overload our systems
Upload content that is unlawful, infringing, or that you do not have the right to share
Use the app to provide medical advice to another person if you are not qualified to do so in your jurisdiction
Resell, sublicense, or commercialise the app or its content without our written permission

Your content

The recipes, journal entries, plans, photos, notes, and other material you create in the app are yours. By using the app you grant us a limited, non-exclusive licence to store and process this content solely so we can run the service for you. We do not claim ownership of your content and do not use it to train AI models.

If you choose to share data with a practitioner using a sharing code, you authorise us to transmit the categories you have enabled to that practitioner's account. You can revoke this at any time from the Profile screen.

Practitioner accounts

If you use Fundamental as a practitioner to manage clients, plans, and herb protocols, you agree that:

You are responsible for your clinical work, your professional licensing, and the accuracy of any plan you share with a client
You will only enter information about clients who have given you informed consent
You will respect any limits a client places on what data they share back with you, and you will delete client data on request

Third-party services

Fundamental relies on third-party services to function, including OpenAI for meal and recipe analysis, OpenStreetMap for location lookup, and (when paid plans launch) the platform's standard payment processors. By using these features you also agree to those providers' own terms. We are not responsible for the availability, accuracy, or privacy practices of third-party services beyond what is described in our Privacy Policy.

Payments and subscriptions

The app is currently free to use during private beta. When paid plans are introduced, the price, billing cadence, free trial details, and refund rules will be shown clearly at the point of purchase. Payments will be handled by the relevant app store or payment processor, and refunds are subject to that processor's policies.

Beta software

Fundamental is being actively developed. Features may change, behave unexpectedly, or be removed without prior notice. We will do our best to preserve your data, but during beta we make no guarantee of uninterrupted service or the long-term availability of any specific feature.

Termination

You can stop using the app at any time. You can delete your account and all associated server-side data from the Profile screen.

We may suspend or terminate an account that violates these terms, that is being used to harm other users, or that has been inactive for an extended period. Where reasonable, we will give you notice and a chance to export your data before doing so.

Disclaimers

The app is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, free of bugs, or appropriate for any specific health goal.

Limitation of liability

To the maximum extent allowed by law, Fundamental, its operators, contributors, and licensors are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profit, or goodwill, arising out of your use of the app, even if we have been advised of the possibility of such damages. Our aggregate liability for any claim relating to the app is limited to the greater of (a) the amount you paid us for the service in the 12 months before the claim, or (b) US$50.

Indemnity

You agree to defend and hold us harmless from any claim brought by a third party arising out of your misuse of the app, your violation of these terms, or your infringement of any other person's rights.

Governing law

These terms are governed by the laws of the jurisdiction in which Fundamental is operated, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction. If you are a consumer, you may also have rights in your local jurisdiction that cannot be waived by contract; nothing in these terms affects those rights.

Changes to these terms

We may update these terms as the app evolves. Material changes will be communicated through the app and on this page. Continued use after changes constitutes acceptance of the updated terms.
